These Terms of Service apply to your use of https://cymer.shop and to purchases made from the Cymer online store. The store is owned and operated by CYMER MARKETING SOLUTIONS LIMITED, company number 12298160, trading as Cymer.
Please read these Terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy. Nothing in these Terms limits rights that cannot lawfully be excluded.
1. Using the store
You may use the store only for lawful purposes. You must provide accurate and current information when placing an order or creating an account and must keep account credentials secure. You must not interfere with the store, introduce malicious code, attempt unauthorised access, scrape the store in breach of law or technical restrictions, or use the store to infringe another person's rights.
2. Product information and condition
We take reasonable care to describe products accurately. Screen settings may cause colours or appearance to differ slightly. Product specifications, included accessories and condition are stated on the relevant product page.
Some products may be pre-owned. Where a product is described as used, refurbished or in a specified condition, reasonable signs consistent with that disclosed condition may be present. The product must nevertheless match its description and satisfy any mandatory legal standards that apply.
3. Prices
The price shown when an order is submitted is the price charged, subject to correction of an obvious error before acceptance. Any applicable delivery charge and tax collected by us will be shown at checkout before the order is submitted. For international deliveries, charges imposed by authorities that are not collected at checkout may be payable by the recipient where applicable.
4. Orders and contract formation
Submitting an order is an offer to buy. After submission, we may send an acknowledgement confirming that the order was received. A binding contract is formed when we send confirmation that the order has been accepted or dispatched, whichever occurs first.
We may decline or cancel an order before acceptance where a product is unavailable, payment cannot be authorised, the order appears fraudulent, delivery is unavailable to the address supplied, an obvious pricing or description error occurred, or the order would breach applicable law. If payment has already been taken for a cancelled order, it will be refunded.
5. Payment
You confirm that you are authorised to use the payment method supplied and that the billing information is accurate. Payments are processed through the payment methods displayed at checkout. Payment providers may apply their own terms and privacy notices.
6. Shipping and delivery
Delivery destinations, processing times and estimates are set out in our Shipping Policy. Delivery dates are estimates unless we expressly agree otherwise.
For United Kingdom consumer orders, risk of loss or damage passes when the goods come into the physical possession of the customer or a person identified by the customer to receive them, except where the customer independently appoints a carrier not offered by us and the law provides otherwise.
If we cannot dispatch within the advertised time, we will provide an updated estimate and any cancellation or refund option required by applicable law.
7. Cancellations, returns and refunds
Cancellations, returns and refunds are governed by our Return and Refund Policy. United Kingdom customers may have statutory cancellation and faulty-goods rights in addition to our voluntary 30-day return policy.
8. Consumer rights
Nothing in these Terms excludes or restricts mandatory consumer rights. In the United Kingdom, these may include rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Customers in the United States retain any non-waivable rights available under applicable federal and state law.
9. Accounts
You are responsible for activity carried out through your account unless caused by our failure to use reasonable care. We may suspend or close an account where reasonably necessary to protect the store, customers or third parties, investigate fraud or misuse, or comply with law.
10. Intellectual property
The store's original text, graphics, branding, layout and other content are owned by or licensed to us and are protected by applicable intellectual-property law. You may use the store for personal, non-commercial shopping purposes. No other licence is granted unless we agree in writing or the law permits the use.
11. Reviews and submitted content
If you submit a review or other content, you confirm that it is accurate, lawful and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting the store. We may remove unlawful, misleading or inappropriate content.
12. Third-party services and links
The store is powered by Shopify and may use third-party payment, delivery, analytics or support services. A third party's own terms may apply to its service. External links are provided for convenience, and we are not responsible for third-party websites that we do not control.
13. Availability and errors
We may update, suspend or discontinue store features and correct errors in product descriptions, availability, delivery information or prices. This does not affect a contract already accepted except where correction is permitted by law or agreed with the customer.
14. Liability
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory consumer rights, or any other liability that cannot legally be excluded.
Subject to the paragraph above, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by events outside our reasonable control, or business losses arising from a consumer purchase. These Terms do not affect any remedy available under mandatory law.
15. Events outside our control
We are not responsible for delay or failure caused by events beyond our reasonable control, but we will take reasonable steps to minimise the effect and will provide any cancellation or refund right required by law.

17. Changes to these Terms
We may update these Terms for legal, security or operational reasons. The version that applies to a purchase is normally the version in force when the order is submitted, unless a change must apply by law.
18. Governing law and disputes
These Terms and contracts made through the store are governed by the law of England and Wales. This choice of law does not deprive a consumer of mandatory protections available under the law of the country or state in which the consumer habitually resides.
The courts of England and Wales have non-exclusive jurisdiction. A consumer may also bring proceedings in any court available to them under mandatory applicable law.
19. Severability
If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
